Terms of Service for Voting Information Project SMS Tool 

Welcome, and thank you for your interest in The Pew Charitable Trusts (“Pew”, “we,” or “us”) and in the Voting Information Project (VIP)’s short messaging service (SMS) tool (“SMS Tool”). These Terms of Service are a legally binding contract between you and Pew regarding your use of the SMS Tool.

PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY.  BY USING THE SMS TOOL YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS OF SERVICE, INCLUDING THE OUR PRIVACY POLICY (COLLECTIVELY, THESE “TERMS”). 

1.      SMS Tool Overview

VIP offers an SMS Tool that provides voters with election information via text message.  Users can text “VOTE” or “VOTO” to a designated short code and receive a responsive text message to find their polling places contact information for election officials, and registration URLs.  The SMS Tool is available in multiple languages. 

2.      Privacy

2.1. Privacy. When using the SMS Tool, you may submit data to Pew, such as your registered address and your mobile phone number (your “Data”).  The SMS Tool does not require any other personally identifiable information.  We know that by giving us your Data, you are trusting us to treat it appropriately.  Pew’s Privacy Policy for the Voting Information Project’s SMS Tool details how we treat your Data and we agree to adhere to those privacy policies.  You agree that Pew may use and share your Data in accordance with our privacy policies. In particular, by sending a text message to Pew, you agree to receive text messages at that number as described in this Privacy Policy.  You may revoke consent at any time by contacting Pew, including by texting STOP. 

2.2. Confidentiality. Pew will treat your Data as confidential information and only use and disclose it in accordance with these Terms (including our applicable privacy policy).  However, your Data is not regarded as confidential information if that Data: (a) is or becomes public, other than through a breach of these Terms by Pew; (b) was lawfully known to Pew before receiving it from you; (c) is received by Pew from a third party without knowledge of breach of any obligation owed to you; or (d) constitutes de-identified or aggregated information that cannot reasonably be linked to you or another individual.

3.      Cost of Participation 

VIP’s SMS Tool requires no purchase or fee for participation.  Carrier message and data rates may apply to each message sent through automated dialing equipment and/or received from the participant.

4.      User Conduct

You agree not to send or otherwise make available content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, or contains hate speech.   

5.      No Guarantee

Pew is not responsible for incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered messages resulting from any form of filtering by your mobile carrier or service provider.

6.      United States Only

The SMS Tool is currently available only to residents of the United States.  You understand and acknowledge that you may not sign up for, access, or attempt to access or use the SMS Tool from countries outside of the United States.

7.      Indemnity

You agree that you will be responsible for your use of the SMS Tool, and you agree to defend, indemnify, and hold harmless Pew and its officers, directors, employees, consultants, affiliates, subsidiaries and agents (collectively, the “Pew Entities”) from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with (i) your access to, use of, or alleged use of the SMS Tool; (ii) your violation of these Terms or any representation, warranty, or agreements referenced herein, or any applicable law or regulation; (iii) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or (iv) any disputes or issues between you and any third party.  We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (and without limiting your indemnification obligations with respect to such matter), and in such case, you agree to cooperate with our defense of such claim.

8.      Disclaimers; No Warranties

THE SMS TOOL AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SMS TOOL ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE PEW ENTITIES SPECIFICALLY (BUT WITHOUT LIMITATION) DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SMS TOOL AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SMS TOOL, INCLUDING BUT NOT LIMITED TO (i) ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (ii) ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE. THE PEW ENTITIES DO NOT WARRANT THAT THE SMS TOOL OR ANY PART THEREOF, OR ANY MATERIALS OR CONTENT OFFERED THROUGH THE SMS TOOL, WILL BE UNINTERRUPTED, SECURE, ACCURATE OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND DO NOT WARRANT THAT ANY OF THE FOREGOING WILL BE CORRECTED.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SMS TOOL OR ANY MATERIALS OR CONTENT AVAILABLE ON OR THROUGH THE SMS TOOL WILL CREATE ANY WARRANTY REGARDING ANY OF THE PEW ENTITIES OR THE SMS TOOL THAT IS NOT EXPRESSLY STATED IN THESE TERMS.

ALL INFORMATION WE RECEIVE FROM YOU IS NOT VERIFIED FOR ACCURACY BY US. 

YOU ASSUME ALL RISK FOR ALL DAMAGES THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO THE SMS TOOL AND ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SMS TOOL. YOU UNDERSTAND AND AGREE THAT YOU USE THE SMS TOOL AND USE, ACCESS, DOWNLOAD, OR OTHERWISE OBTAIN MATERIALS OR CONTENT THROUGH THE SMS TOOL AND ANY ASSOCIATED SITES OR SERVICES AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING YOUR MOBILE DEVICE USED IN CONNECTION WITH THE SMS TOOL) OR LOSS OF DATA THAT RESULTS FROM THE USE OF THE SMS TOOL OR THE DOWNLOAD OR USE OF SUCH MATERIALS OR CONTENT.  SOME JURISDICTIONS MAY PROHIBIT A DISCLAIMER OF WARRANTIES AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.

9.      Limitation of Liability

IN NO EVENT WILL THE PEW ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SMS TOOL OR ANY MATERIALS OR CONTENT ON THE SMS TOOL, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER LEGAL THEORY, WHETHER OR NOT THE PEW ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

YOU AGREE THAT THE AGGREGATE LIABILITY OF THE PEW ENTITIES TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF RELATING TO THE USE OF OR ANY INABILITY TO USE THE SMS TOOL (INCLUDING ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SMS TOOL) OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO $100.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. ACCORDINGLY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

EACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS TO ALLOCATE THE RISKS UNDER THESE TERMS BETWEEN THE PARTIES. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS. THE LIMITATIONS IN THIS SECTION 9 WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

10.  Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania without regard to conflict of law principles.  To the extent that any lawsuit or court proceeding is permitted hereunder, you and us agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within Philadelphia County, Pennsylvania for the purpose of litigating all such disputes.

11.  Dispute Resolution

11.1. No Class Actions. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND PEW ARE EACH WAIVING THE RIGHT TO PARTICIPATE IN A CLASS ACTION AND THAT YOU AND PEW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY.

11.2. Enforceability. If Subsection 11.1 is found to be unenforceable or if the entirety of this Section 11 is found to be unenforceable, then the entirety of this Section 11 shall be null and void and, in such case, the parties agree that the exclusive jurisdiction and venue described in Section 10 shall govern any action arising out of or related to these Terms.

12.  Termination

Pew reserves the right, in its sole discretion, to cancel or suspend the SMS Tool, in whole or in part, for any reason, with or without notice to you.

13.  Changes to the Terms

We reserve the right, at our discretion, to change these Terms on a going-forward basis at any time.  Please check these Terms periodically for changes.  In the event that a change to these Terms materially modifies your rights or obligations, we will make reasonable efforts to notify you of such change.  Disputes arising under these Terms will be resolved in accordance with the Terms in effect that the time the dispute arose.

14.  Other

14.1. Assignment. You may not assign these Terms without Pew’s prior written consent, which may be withheld in Pew’s sole discretion.  Pew may assign these Terms at any time without notice to you.

14.2. Entire Agreement.  These Terms (including any applicable privacy policy) constitute the entire agreement between you and Pew, and they supersede any other prior or contemporaneous agreements, terms and conditions, written or oral concerning its subject matter.

14.3. Interpretation.  The use of the terms “includes”, “including”, “such as”, and similar terms, will be deemed not to limit what else might be included.

14.4. No Waiver.  A party’s failure or delay to enforce a provision under these Terms is not a waiver of its right to do so later.

14.5. Severability.  If any provision of these Terms is determined to be unenforceable by a court of competent jurisdiction, that provision will be severed and the remainder of terms will remain in full effect.

14.6. Third Party Beneficiaries. There are no third party beneficiaries to these Terms.

Privacy Policy for Voting Information Project SMS Tool

Welcome, and thank you for your interest in The Pew Charitable Trusts (“Pew”, “we,” or “us”) and the Voting Information Project (VIP) short messaging service (SMS) Tool, as described in Terms of Service (the “Terms of Service”) for the VIP SMS Tool.

 This Privacy Policy describes the information that we gather from you, how we use and disclose your information, and the steps we take to protect your information provided through our SMS Tool.  By using the SMS Tool, you consent to the privacy practices described in this policy.

 This Privacy Policy is incorporated into and is subject to the Terms of Service.  Capitalized terms that are not defined in the Privacy Policy have the meaning given to them in the Terms of Service.

 1.      Your Consent 

 By providing us with your Data, as defined below, you consent to the collection and use of this information in accordance with the purposes described above and this Privacy Policy.  In particular, by sending a text message to Pew, you agree to receive text messages at that number from Pew as described in this Privacy Policy.  You may revoke consent at any time by contacting Pew, including by texting STOP. 

 2.      Information We Collect 

 When you use the SMS Tool, you may provide your residential address and your mobile phone number (your “Data”). 

 3.      Limits on Uses of Information Collected

 Our primary uses of the data you submit to us is to provide you with the nearest polling place location, contact information for local election officials, and a link to check voter registration status.  We may use your Data in the following ways:

  • to operate, maintain, enhance and provide you with the SMS Tool;
  • to send you administrative notifications, such as security or support and maintenance advisories;
  • to analyze, benchmark and conduct research on user data and user interactions with the SMS Tool; or
  • to address intellectual property infringement, right of privacy violations or defamation issues related to content you input into the SMS Tool.

4.      Disclosure of Information 

We may employ third parties to perform functions on our behalf including, without limitation, administering components of the SMS Tool.  We may share your Data with these third parties in order to provide these services.  We make commercially reasonable efforts to confirm that these third parties are prohibited from using your Data for any other purpose.

We may also share your Data with Pew partner organizations, independent contractors and other entities and individuals who work on Pew projects in order to further Pew’s charitable purposes.  We make commercially reasonable efforts to confirm that these third parties are prohibited from using your Data for any other purpose.

We will not sell your Data or any other information we collect about your activity on our SMS Tool.

We reserve the right to disclose your Data as required by law, when we believe that disclosure is necessary to protect our rights, to comply with a legal obligation or a request from governmental authorities conducting an investigation, to verify or enforce compliance with the policies governing the SMS Tool, or to protect the legal rights, interests, or safety of Pew, our users or others.

5.      Control Over Disclosure of Data

You may, of course, decline to share your Data with us, in which case we may not be able to provide to you some of the features and functionality of the SMS Tool.  Please note that we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics.  We will retain your information for as long as needed to provide you services.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

6.      Our Commitment to Data Security

We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of your information.  If you choose to send us your Data, we will implement reasonable security measures according to our security policy.  We cannot, however, ensure or warrant the security of any information you transmit to us through the SMS Tool and you do so at your own risk.  We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps.  We may post a notice on our website if a security breach occurs or use other means to contact you.   

7.      International Visitors

The SMS Tool is hosted in the United States and is intended solely for visitors located within the United States.  If you choose to use the SMS Tool from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your Data outside of those regions to the United States for storage and processing, and by providing your Data through the SMS Tool, you consent to that transfer, storage, and processing.

8.      Changes and Updates to this Privacy Policy

Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which may be revised periodically at our sole discretion, as provided in Section 13 of the Terms of Service.  If we modify the Privacy Policy, we will make it available on our website and will indicate the date of the latest revision.  In the event that the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change prior to the change becoming effective.  Our amended Privacy Policy will automatically take effect after it is made available on our website.  If you do not agree with any changes to the Privacy Policy, you may stop using the SMS Tool.  Your continued use of the SMS Tool after the revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.
