Terms of Service
The Voting Information Project (VIP), a project of Democracy Works, provides users with official election and polling place information, collected from and verified by state and local election officials. VIP does not collect any personally identifiable information and does not collect or distribute any information entered by a user, including address information.
VIP is a nonpartisan online voter resource, partnering with organizations and election officials committed to leveraging technology to provide official voting information to voters where they look for it most. By using, browsing or accessing our Web site located at http://www.votinginfoproject.org (the “Site”) and the services offered on the Site (collectively with the Site, the “Services”), you agree to be bound by these Terms of Use and the terms of the Privacy Policy, as in effect at the time you access the Site and/or the Services. All right, title, and interest in and to VIP (excluding content provided by users) are and will remain the exclusive property of Democracy Works and its licensors.
Use Guidelines and Prohibitions
You agree to use the Services solely for personal, not-for-profit or educational purposes. You agree not to use the Services to: (a) violate any law, or (b) disobey any requirements, procedures, policies or regulations of networks connected to the Services, or interfere with or disrupt the Services, the Site or servers or networks connected to the Site.
By accessing our Site or any other service provided through our Site, you agree to abide by the following standards of conduct. You agree that you will not, nor will you authorize or facilitate any attempt by another person, to use our Site or any Services to:
1) Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of the Site;
2) Transmit any content that:
a) includes files or hyperlinks which contain viruses, worms, Trojan horses, spyware, malware, or any other destructive features, or any data otherwise intended to interfere with the proper working of the Site;
b) is intended to harass, threaten, or intentionally embarrass or cause distress to another person or entity;
c) infringes any other party’s copyright, trademark, or trade secret;
d) constitutes an unsolicited advertisement or unlawful promotion of products or services;
e) impersonates another person; or
f) encourages conduct that would constitute a criminal or civil offense;
3) Invade the privacy of any person, including but not limited to posting personally identifying or otherwise private information about or photos of a person without their consent (or their parent’s consent in the case of a child under 13 years of age); or
4) Violate any federal, state, local, or international law or regulation.
Accessing (or attempting to access) any of our resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our resources through any automated, unethical or unconventional means.
Indemnification
By using this Website, you agree to indemnify, hold harmless, and defend Democracy Works and its directors, employees, agents, partners and content providers from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys’ fees, resulting directly or indirectly from a claim by you or a third-party that arises in connection with: (i) your use of and access to the Site and/or the Services; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that any sharing of information caused damage to a third-party. This defense and indemnification obligation will survive these Terms of Service and your use of the Site.
Limitation of Liability
In no event shall Democracy Works, nor its directors, employees, agents, partners, or content providers be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to your use of the Site and/or the Services for any direct, indirect, incidental, consequential, special, punitive or exemplary loss or damages of any kind whatsoever which may be incurred by you as a result of your use of the Site and/or the Services, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
Termination and Access
Democracy Works reserves the right, in our sole discretion, to terminate your access to all or any part of the Services at any time, with or without notice, effective immediately, including but not limited to as a result of your violation of any of these Terms of Services or any law.
Choice of Law
Any claim arising hereunder shall be construed in accordance with the substantive and procedural laws of the State of New York, without regard to principles of conflict of laws. Subject to the section entitled “Dispute Resolution” below, you agree that any dispute arising from or relating to the subject matter of these Terms of Services shall be governed by the exclusive jurisdiction and venue of the courts of the State of New York or a federal court sitting in New York County, New York.
Dispute Resolution
In the interest of resolving disputes between you and Democracy Works in the most expedient and cost effective manner, you and Democracy Works agree that every dispute arising in connection with these Terms of Services will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms of Services, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms of Services. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS OF SERVICES, YOU AND SUPPLIER ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
